Terms of Service

These Terms govern your use of the Reminisce iOS app and this website (together, the “Service”), operated by Reminisce (“we”, “us”). By connecting your photo library or otherwise using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

1. A free beta service

Reminisce is currently in public beta. It is provided free of charge during this period. Beta software changes quickly: features described on this site may be added, altered, or removed, and the Service may be interrupted or discontinued, without notice. We’ll try to give you reasonable notice of anything that affects your access to your own data.

2. Provided “as is”

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or entirely secure, or that any story, date, or place Reminisce generates from your photos will be accurate. You use the Service at your own discretion and risk.

3. Limitation of liability

To the maximum extent permitted by applicable law, Reminisce and its team are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, photos, profits, or goodwill, arising out of or relating to your use of, or inability to use, the Service — even if we’ve been advised of the possibility of such damages.

Because the Service is currently free, our total aggregate liability for any claim arising from these Terms or the Service is limited to €0. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

We strongly encourage you to keep your own backup of any photos important to you. Reminisce is a way to rediscover your memories, not a substitute for your primary photo backup.

4. Your photos and content

You keep ownership of your photos and everything in them. By connecting your library, you grant us a limited license to store, process, and analyze your photos solely to operate and improve the Service for you — for example, to build the memory digests we send you. We do not sell your photos, and we do not use your photos to train models on behalf of, or for the benefit of, other users.

5. Your data & privacy

We are the data controller for personal data processed through the Service, within the meaning of the EU General Data Protection Regulation (GDPR). This section describes, in plain language, what we actually collect and why — it’s written to match what our systems store, not a generic template.

What we collect

  • Account data — your username, an email address if you give us one, your timezone, and how often you’d like a memory digest.
  • Your photo library — copies of the photos you connect, together with the technical details already embedded in those files: when they were taken, the camera or device that took them, orientation, and, where the photo itself carries it, its GPS location.
  • A resolved place name — where a photo has GPS coordinates, we turn them into a general place description (for example, a neighbourhood, city, and country) so a memory can be described to you in words, not just coordinates.
  • Recognition data — to group your photos into events and let you label recurring faces with a name and relationship, we compute mathematical representations (embeddings) of faces and of overall photo content, and keep small cropped face images alongside them. A face embedding lets our systems recognize the same face again and is treated as biometric data under Article 9 GDPR.
  • People you name — any name, relationship, or hidden/visible setting you assign to a recurring face is stored against your account only.
  • AI-written content — the short titles, summaries, and theme tags our systems generate to describe an event (a trip, a birthday, a day at the beach) in your library.

Special category data

Photos can incidentally contain sensitive information — health, sexuality, religious or political symbols, and similar — and face data is biometric. We treat your library as containing special category data under Article 9 GDPR and handle it with that extra care throughout: it is analyzed only to provide the Service to you, never for advertising, and never shared to build a profile of you for any other purpose.

Why we process it (legal basis)

We process your account and photo data to perform our contract with you (Article 6(1)(b) GDPR) — namely, to run the Service you’ve asked us to provide. Where processing involves biometric data (face grouping), we rely on your explicit consent (Article 6(1)(a) and Article 9(2)(a)). You can withdraw that consent at any time by asking us to disable face grouping on your account, without losing the rest of the Service.

Where it’s processed

We care about where your photos live. Reminisce runs on our own infrastructure, hosted in the European Union — including the machine-learning models that recognize faces, screen content, and understand your library, and the language model that writes your memory narratives. We don’t route your photos through third-party cloud AI providers to provide the Service.

How long we keep it

We keep your data for as long as your account is active. If you delete your account, we delete your photos and derived data (embeddings, face crops, event narratives) within a limited window needed to remove it from backups and processing queues.

Your rights

Under the GDPR, you have the right to access, correct, delete, restrict, or export your personal data, to object to certain processing, and to withdraw consent at any time. You can also lodge a complaint with your local data protection supervisory authority. To exercise any of these rights, contact us — see Section 9.

Security

We use encryption in transit and access controls to protect your data. No system is completely secure, and — consistent with Sections 2 and 3 above — we can’t guarantee absolute security of information transmitted to or stored by the Service.

6. Acceptable use

Please don’t upload photos or content you don’t have the right to share, use the Service to break the law, or attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or other users’ data.

7. Changes to these Terms or the Service

We may update these Terms or the Service as it evolves, especially during the beta period. If we make a material change, we’ll aim to let you know — for example, in the app or by email — before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

8. Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you materially breach these Terms.

9. Governing law & contact

These Terms are governed by the laws of the European Union member state in which Reminisce is established, without prejudice to any mandatory consumer-protection rights you have under the law of your own country of residence.
